Buying a home in Pismo Beach

Most of the city lies in the Coastal Zone, and its updated land use plan waits on the City Council's acceptance of the Coastal Commission's modifications. The State's Very High and High fire zones cover much of its land, its bluffs decide how close a house may stand to the edge, and it no longer issues new short-term rental licenses. The records are below.

What a loan meets in Pismo Beach

Rules in the public record that can bear on buying in Pismo Beach.

The land use plan in force today

The City Council adopted an updated General Plan and coastal Land Use Plan, and the Coastal Commission approved the Land Use Plan with modifications, one of them on short-term rentals. The City says the amendment takes effect only after the Council accepts the modifications by resolution and the Commission's Executive Director reports it, and that no Council meeting is scheduled for that yet. Until then the certified plan already in place governs. The City applies one zoning code inside the Coastal Zone and another outside it, and it says the Zoning Code update and the Safety Element update are still to come.

Bluff-top lots and the setback rule

Much of the northwest shoreline is cliffs and bluffs. The City's safety element requires a building to stand far enough back from the bluff top to last without a seawall, can require a geologic study, and bars new building on the bluff face apart from public beach stairways and accessways, so an addition or a rebuild on a bluff lot starts from those rules.

An ADU in the Coastal Zone needs a coastal permit

The City's code requires a coastal development permit and a building permit for an accessory dwelling unit anywhere in the Coastal Zone, and a zoning clearance and a building permit outside it. It keeps ADUs out of mobile home parks and recreational vehicle parks, off slopes steeper than its limit and out of the upper part of Pismo Heights, and the City's page says a complete application is approved, or a notice of what is missing sent, within the State's time limit, with no public hearing.

The short-term rental freeze

The City stopped issuing new short-term rental licenses, and the ones already issued stay under the rules. Vacation rentals, which do not require the owner to live in the home, are allowed only in certain zones of the downtown core, and a permit does not pass to a buyer, who has to apply for a new one.

Fire zones in the hills and below them

The State Fire Marshal's map, which the City adopted as its fire hazard severity zones, puts Very High and High zones over much of the city's land: in the hillsides, on lower ground along Pismo Creek, and near the shore in the northwest of the city. The City also adopted the State's wildland-urban interface code. The zones bring the State's wildfire building standards for new homes and a hazard disclosure at sale. CAL FIRE's county unit notes that the maps guide planning, and that insurers rate wildfire risk with their own models.

Loans that come up in Pismo Beach

Programs with a rule that touches something on this page, and the rule. Other programs can work here too.

  • Construction loan

A new home in a High or Very High fire zone, which cover much of the city's land, follows the State's wildfire building standards and the wildland-urban interface code the City adopted, and on a bluff lot the City's setback and geologic study rules decide where the house can stand.

  • ADU financing

Inside the Coastal Zone, which takes in most of the city, the City's code requires a coastal development permit along with the building permit for an accessory dwelling unit, which belongs in the plan from the start.

Pre-qualification letter in Pismo Beach

In Pismo Beach, the listing agent reads your pre-qualification letter beside the City's records on the lot. Most of the city lies in the Coastal Zone, under the City's certified coastal program. The City has adopted an updated land use plan, but it takes effect only after the City Council accepts the Coastal Commission's modifications. On a bluff-top lot, the City's safety element requires a building to stand far enough back from the edge to last without a seawall, and it can require a geologic study. The State Fire Marshal's map, which the City adopted by ordinance, puts Very High and High zones over much of the city's land, in the hills and on lower ground along Pismo Creek and near the shore. Those zones bring a hazard disclosure at sale. CAL FIRE's county unit notes that insurers rate wildfire risk with their own models, so the premium in your payment comes from the insurer's model. FEMA's maps show flood zones along the two creeks and coastal high-hazard zones on the shore. USDA's map places the city outside its eligible area. Above the county's conforming loan limit, your letter names a jumbo loan, not a conventional one. Our letter spells out the program and the amount your file supports, and states that it is not a commitment to lend.

Investment property in Pismo Beach

Pismo Beach has stopped issuing new short-term rental licenses, and a DSCR loan rests on the rent a lender can count. The licenses already issued stay under the rules, and vacation rentals are allowed only in certain zones of the downtown core. A permit does not pass to you as the buyer; for a vacation rental you have to apply for a new one. So what the seller earned by the night is not the rent a DSCR lender reads for you; the long-term market rent on the appraiser's schedule is. The City's code requires a coastal development permit and a building permit for an accessory dwelling unit anywhere in the Coastal Zone, and a zoning clearance and a building permit outside it. It keeps ADUs out of mobile home parks and recreational vehicle parks, off steep slopes and out of the upper part of Pismo Heights. That decides where an ADU you finance to rent can exist at all. The Coastal Commission's approval of the City's updated land use plan carries a modification on short-term rentals, and none of it is in force until the City Council accepts the modifications. In Pismo Beach the freeze holds the nightly rental stock at the licenses already issued, and a sale does not move a license to you.
